TERMS OF SERVICE

1. Agreement
By downloading or using Owlish ("the App"), you agree to these Terms. If you do not agree, do not use the App. The App is provided by Kunal Singh ("we", "us").
2. What Owlish is
Owlish is a bedtime alarm. At a time you choose, it sounds a series of alarms that stop when your phone is set face-down and still, or when you record a short video explaining why you are staying up. Those videos are stored on your device.
3. What Owlish is not — please read this section
Owlish is not a medical device, and it does not diagnose, treat, cure, or prevent any condition. It is not sleep therapy, not a sleep tracker, and not a substitute for professional medical advice.
Owlish does not measure whether you are asleep. It detects only that your phone is stationary and face-down.
If you have a sleep disorder, insomnia, or any medical condition affecting your sleep, consult a qualified healthcare professional. Do not use Owlish in place of prescribed treatment.
If you find that using Owlish increases anxiety around falling asleep, stop using it. Lying awake calmly is not a failure state, and no feature of the App should be treated as a measure of your health.
Do not rely on Owlish for any purpose where a missed or delayed alarm could cause harm. Alarms depend on iOS behaviour, system permissions, device settings, battery state, and other factors outside our control.
4. Eligibility
You must be at least 13 years old to use the App. If you are under the age of majority where you live, you may use it only with a parent or guardian's consent, and they agree to these Terms on your behalf.
5. Your recordings
Videos you record with Owlish are yours. They are stored on your device.
We never receive, access, store, transmit, or process them. We claim no licence or ownership over them, because we never come into possession of them.
You are solely responsible for:
- What you record, including anyone else who appears or is heard in a recording
- Obtaining consent from anyone else captured in a recording
- What you choose to share, and where
- Backing up anything you want to keep
Deleting the App permanently destroys all recordings. We cannot recover them under any circumstances.
If you share a recording, it leaves our control entirely. We are not responsible for how it is subsequently used, copied, or distributed by others.
6. Subscriptions
The App offers auto-renewing subscriptions. Payment is charged to your Apple ID at confirmation. Subscriptions renew automatically unless cancelled at least 24 hours before the current period ends. Your account is charged for renewal within 24 hours of the end of the period.
Free trials, where offered, apply once per subscription group per Apple ID. Unused portions of a trial are forfeited when you purchase a subscription.
Manage or cancel subscriptions in your Apple ID account settings. Deleting the App does not cancel a subscription.
Refunds are handled by Apple under Apple's policies. We cannot issue refunds.
We may change prices for future billing periods with notice, as permitted by Apple.
7. Acceptable use
You agree not to:
- Reverse engineer, decompile, or modify the App
- Use it in any unlawful way, or to record anyone without their consent
- Use it in any way that could harm you or another person
8. Availability
The App depends on Apple's platform and services. We do not guarantee uninterrupted operation. Features may change, be removed, or stop functioning following iOS updates.
9. Disclaimer of warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the App will be uninterrupted, error-free, secure, that alarms will sound reliably or at all, that defects will be corrected, or that the App will meet your requirements or improve your sleep in any way.
Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Kunal Singh SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, or for any loss of profits, data, recordings, goodwill, or other intangible losses, arising out of or relating to your use of or inability to use the App.
This includes, without limitation, damages arising from: any alarm that fails to sound, sounds late, or sounds unexpectedly; any loss of recordings; any effect on your sleep, health, or wellbeing; any consequence of oversleeping or missed obligations; and any disclosure of a recording you chose to share.
OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) USD 50.
These limitations apply regardless of the legal theory and even if we have been advised of the possibility of such damages. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
11. Indemnification
You agree to indemnify, defend, and hold harmless Kunal Singh and its officers, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or connected with: your use of the App; your violation of these Terms; your violation of any law or third-party right; and any content you record or share, including any claim by a person appearing in or identifiable from a recording.
12. Termination
You may stop using the App at any time by deleting it. We may suspend or discontinue the App, in whole or part, at any time. Sections 5, 9, 10, 11, and 13 survive termination.
13. Governing law
These Terms are governed by the laws of the State of California, United States, without regard to conflict of laws principles. Any dispute shall be brought in the state or federal courts located in San Diego County, California, and you consent to that jurisdiction.

14. Apple
These Terms are between you and Kunal Singh, not Apple. Apple is not responsible for the App or its content and has no obligation to provide support or maintenance. Apple is a third-party beneficiary of these Terms and may enforce them against you.
15. Changes
We may update these Terms. Continued use after changes take effect constitutes acceptance. The date above shows the last revision.
16. Severability
If any provision is held unenforceable, the remainder stays in full effect.
